That is, I suspect he is a domestic violence offender, and the girlfriend is in a desperate situation with no idea how to get out. I wouldn't be surprised to find out one day that he has killed both the baby and the girlfriend, or at least one of them. I hope they do decide he can be charged with a felony, and hopefully he gets convicted. She might be able to get away during his prison time if that happens (if he doesn't kill her before he goes to prison). Very sad. I certainly hope I'm wrong about the severity of the situation.
